Terms of Use
Important Medical Emergency Notice
DO NOT USE THIS WEBSITE, THE PATIENT PORTAL, EMAIL, OR TEXT MESSAGING FOR A MEDICAL EMERGENCY. If you believe you are experiencing a medical emergency, call 911 or go to the nearest emergency department. If you are experiencing a mental-health crisis or suicidal thoughts, call or text 988 in the United States. Electronic messages may not be reviewed immediately.
Introduction and Acceptance of Terms
Jenla Health, LLC, doing business as Jenla Health (collectively, "Jenla Health," "Jenla," "we," "our," or "us"), operates JenlaHealth.com and related pages, links, content, communications, and non-clinical services (collectively, the "Website"). These Terms of Use ("Terms") govern your access to and use of the Website and any non-clinical services offered by Jenla through the Website.
Clinical services made available through links on the Website are provided by independent licensed clinicians and professional medical entities affiliated with or supported by OpenLoop Health, Inc. (collectively, the "Clinical Providers"). Jenla is not a medical practice and does not itself diagnose, treat, prescribe, or make clinical decisions. The Clinical Providers exercise independent professional judgment and are solely responsible for clinical care. OpenLoop Health, Inc. and its technology or service partners may support the intake, patient portal, communications, payment, fulfillment, and administrative processes associated with care.
By accessing or using the Website, creating an account, submitting an intake form, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Website. Additional terms presented during intake, checkout, telehealth consent, or enrollment also apply. If those terms conflict with these Terms as to clinical care or a particular transaction, the more specific terms control for that subject.
1. Privacy
Jenla's Privacy Policy explains how Jenla collects, uses, discloses, and safeguards information handled through the Website. The Privacy Policy is available at jenlahealth.com/privacy-policy and is incorporated into these Terms by reference.
Information created or maintained by a Clinical Provider in connection with clinical care may be protected health information governed by the Health Insurance Portability and Accountability Act and other applicable laws. The OpenLoop-affiliated medical practices' Notice of Privacy Practices describes how that information may be used and disclosed and is available at openloophealth.com/notice-of-privacy-practices. Jenla's Website Privacy Policy and the applicable Notice of Privacy Practices serve different purposes; both should be reviewed.
2. Changes to These Terms
We may revise these Terms from time to time. The revised Terms will be posted on the Website with an updated effective date. Changes apply prospectively when posted unless applicable law requires additional notice or consent. Your continued use of the Website after the effective date of revised Terms constitutes acceptance of those revisions. Material changes to subscription or clinical terms will be addressed as required by applicable law.
3. The Website Does Not Provide Medical Advice
Content on the Website is provided for general informational and educational purposes only. It is not medical advice and is not a substitute for advice, diagnosis, or treatment from a qualified healthcare professional. Do not disregard or delay seeking professional medical advice because of information on the Website.
Submitting information through the Website does not establish a clinician-patient relationship. A clinician-patient relationship is established only when an appropriately licensed Clinical Provider accepts you for care in accordance with applicable law. Treatment, medication, dosage, and eligibility decisions are made solely by the Clinical Provider. No particular medication, prescription, treatment, or outcome is guaranteed.
4. Reliance on Information Posted
We seek to provide useful and accurate information, but health information changes and Website content may not be complete, current, or applicable to your circumstances. You assume responsibility for decisions made in reliance on general Website content. Product descriptions, estimated results, testimonials, and educational materials do not constitute promises or guarantees. Individual experiences and results vary.
5. Communication Preferences, Electronic Notices and Signatures
By providing an email address or telephone number, you agree that Jenla, the Clinical Providers, OpenLoop, pharmacies, and service providers involved in your requested services may send operational communications relating to your account, intake, appointments, orders, treatment, billing, safety, and support, subject to applicable law and the consents presented to you. Standard message and data rates may apply. Communications may not always be secure.
Marketing emails or text messages will be sent only as permitted by law and applicable consent. You may withdraw marketing consent using the unsubscribe instructions in an email or the opt-out method stated in a text. Opting out of marketing does not prevent necessary transactional, safety, account, or care-related communications.
You consent to receive notices and disclosures electronically. Selecting a checkbox, clicking an acceptance button, typing your name, or taking a similar electronic action may constitute your electronic signature to the extent permitted by law. You are responsible for maintaining current contact information and copies of important electronic communications.
6. Changes to the Website
We may modify, suspend, withdraw, or discontinue any part of the Website, content, program presentation, or non-clinical service at any time. Medication, product, pricing, provider, pharmacy, and geographic availability may change. We do not guarantee uninterrupted Website availability and may restrict access for maintenance, security, legal, operational, or other reasons.
7. Ownership of the Website and Content
The Website and its original text, graphics, photographs, video, audio, design, layout, software, and other content are owned by Jenla or used under license and are protected by intellectual-property laws. Subject to these Terms, Jenla grants you a limited, personal, revocable, non-exclusive, non-transferable license to access and use the Website for lawful, non-commercial purposes. No ownership rights are transferred to you.
8. Trademarks
Jenla Health, its logos, and its related names, designs, slogans, and service marks are trademarks or trade dress of Jenla or its licensors. OpenLoop and third-party names and logos belong to their respective owners. You may not use any mark displayed on the Website without the prior written permission of its owner, except as permitted by law.
9. Your Use of the Website
You may use the Website only for lawful personal purposes. You agree that information you submit will be accurate, current, and yours to provide. You are responsible for maintaining the confidentiality of account credentials and for activity occurring under your account. Notify the appropriate support contact promptly if you suspect unauthorized access.
You may not: impersonate another person; submit false, fraudulent, or misleading information; use another person's payment method without authorization; interfere with Website operation or security; introduce malware; attempt unauthorized access; scrape, crawl, copy, reverse engineer, or use automated systems against the Website except as expressly permitted; exploit Website content commercially; harass personnel or other users; or use the Website in violation of law. We may investigate suspected violations and cooperate with lawful requests from regulators or law enforcement.
10. Pharmacy and Fulfillment; Shipping and Packaging
If a Clinical Provider determines that a prescription is appropriate, the prescription may be sent to a partner pharmacy or, where permitted and operationally available, another pharmacy selected in accordance with applicable law. Prescription decisions remain within the independent professional judgment of the Clinical Provider. A submitted intake or payment does not guarantee that a prescription will be issued.
Pharmacy transfers may occur for availability, licensure, pricing, fulfillment, or operational reasons as permitted by law and consistent with patient instructions where required. Shipping estimates are not guarantees and may be affected by clinical review, identity verification, pharmacy processing, inventory, carrier delays, weather, holidays, address errors, or legal restrictions. You are responsible for providing a valid delivery address, receiving shipments promptly, inspecting them, and following all storage and use instructions. Keep all medications away from children and other persons for whom they were not prescribed. Some packages may not be child resistant where permitted by law.
Partner pharmacies that may be used include the following. The pharmacy used for a particular prescription depends on clinical appropriateness, licensing, location, availability, and applicable law.
| Pharmacy | Website | Address | Telephone |
|---|---|---|---|
| Red Rock Compounding Pharmacy | redrockhomepharmacy.com | 1240 East 100 South, Suite 220, St. George, UT 84790 | 435-703-2900 |
| Health Warehouse | healthwarehouse.com | 7107 Industrial Rd., Florence, KY 41042 | 800-748-7001 |
| Precision Medicine | precisionmeds.com | 2657 Merrick Road, Bellmore, NY 11710 | 516-833-6262 |

State Coverage
Services are available in all 50 states and Washington D.C. Medication and product availability varies based on clinical appropriateness, applicable federal and state laws, or other regulatory requirements. Not all therapies are available in all states. Availability is subject to change.
Payment, Subscriptions and Automatic Renewal
By providing an accepted payment method, you authorize Jenla and its payment processors or service providers to charge amounts disclosed at checkout, including applicable taxes and recurring subscription charges. If your payment method is invalid, cannot be verified, or is declined, enrollment, fulfillment, or access may be delayed, suspended, or cancelled. You remain responsible for amounts properly due.
Unless expressly stated otherwise, services are cash pay and are not billed to insurance. We do not promise that any payment will be reimbursed by insurance or eligible for payment or reimbursement through a health savings account or flexible spending account. You should consult your plan administrator or tax adviser.
If you enroll in a recurring program, the price, billing cadence, renewal terms, and cancellation deadline will be disclosed before purchase. Your subscription renews and your payment method may be charged until you cancel in accordance with the disclosed process. Any installment or third-party financing service is governed by that provider's separate terms and privacy practices.
11. Refunds and Cancellations
Purchases, cancellations, medication orders, and refunds are governed by Jenla's Cancellation and Refund Policy, available at jenlahealth.com/cancellation-refund-policy, and by any additional terms displayed at checkout. Because clinical, pharmacy, laboratory, shipping, and administrative work may begin shortly after an order is submitted, some fees may become nonrefundable as described in that policy and as permitted by law. Nothing in these Terms limits rights that cannot lawfully be waived.
12. Promotions, Referrals and Sweepstakes
Jenla may offer discounts, promotions, referral programs, or sweepstakes from time to time. Each offer may have additional eligibility requirements, expiration dates, geographic limits, and official rules. Offers may not be combined unless expressly stated, have no cash value, and may be modified or withdrawn as permitted by law. Additional promotion-specific terms control if they conflict with these Terms.
13. Suspension and Termination
Jenla may suspend or terminate access to the Website or non-clinical services for fraud, misuse, threats, nonpayment, security concerns, violation of these Terms, legal or regulatory reasons, or discontinuation of a service. Termination by Jenla does not direct or override a Clinical Provider's professional decisions, continuity-of-care duties, or obligations under applicable law. Provisions that by their nature should survive termination — including ownership, disclaimers, liability limitations, indemnification, payment obligations, and dispute-resolution provisions — will survive.
14. Links and Third-Party Services
The Website may link to or integrate with OpenLoop, Clinical Providers, pharmacies, laboratories, payment processors, shipping carriers, social networks, and other third parties. Those services may be governed by separate terms and privacy policies. Jenla does not control every third-party service and is not responsible for third-party content, availability, security, or conduct except to the extent liability cannot be excluded by law. A link does not necessarily constitute endorsement.
15. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND JENLA'S NON-CLINICAL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." JENLA DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. JENLA DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY PARTICULAR HEALTH, WEIGHT, OR OTHER RESULT WILL BE ACHIEVED.
CLINICAL PROVIDERS ARE INDEPENDENT PROFESSIONALS RESPONSIBLE FOR THEIR OWN CLINICAL JUDGMENT AND SERVICES. NOTHING IN THIS SECTION DISCLAIMS A DUTY OR LIABILITY THAT CANNOT BE DISCLAIMED UNDER APPLICABLE LAW.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JENLA AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND NON-CLINICAL SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST DATA; LOSS OF GOODWILL; OR BUSINESS INTERRUPTION ARISING FROM OR RELATING TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.
TO THE FULLEST EXTENT PERMITTED BY LAW, JENLA'S AGGREGATE LIABILITY FOR CLAIMS ARISING FROM OR RELATING TO THE WEBSITE OR JENLA'S NON-CLINICAL SERVICES WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS OR THE AMOUNT YOU PAID DIRECTLY TO JENLA FOR THE NON-CLINICAL SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW, INCLUDING TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED.
17. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Jenla and its owners, officers, employees, contractors, agents, licensors, successors, and assigns from third-party claims, liabilities, losses, damages, judgments, costs, and reasonable attorneys' fees arising from your unlawful use of the Website, your material violation of these Terms, your infringement of another person's rights, or information or content you submit. Jenla may control the defense of a covered claim, and you agree to cooperate reasonably. This section does not require indemnification for Jenla's own unlawful conduct to the extent prohibited by law.
18. Governing Law and Jurisdiction
These Terms and disputes concerning Jenla's Website or non-clinical services are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent federal law applies. Subject to the arbitration provision below, any court proceeding permitted under these Terms must be brought in a state or federal court located in Los Angeles County, California, and each party consents to personal jurisdiction and venue there. Clinical services may also be governed by the law of the state in which the patient is located and by separate terms applicable to the Clinical Provider.
19. Dispute Resolution and Individual Arbitration
Before filing a claim concerning Jenla's Website or non-clinical services, the complaining party must send written notice describing the dispute and requested relief. Notices to Jenla must be sent to support@jenlahealth.com with "Legal Dispute Notice" in the subject line. The parties will attempt in good faith to resolve the dispute informally for at least 30 days after receipt of notice.
If the dispute is not resolved informally, and except for matters eligible for small-claims court or requests for temporary injunctive relief concerning intellectual property, the dispute will be resolved by individual binding arbitration administered by JAMS under its applicable consumer arbitration rules. The arbitration may be conducted by videoconference, telephone, written submissions, or in person as the arbitrator determines consistent with applicable rules. Any in-person hearing will occur in Los Angeles County, California, unless the parties agree otherwise or applicable law requires another location.
YOU AND JENLA WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, CONSOLIDATED, COLLECTIVE, OR REPRESENTATIVE ACTION, TO THE EXTENT THIS WAIVER IS PERMITTED BY LAW.
The arbitrator may award relief available to the individual claimant but may not award relief for persons who are not parties to the arbitration.
If applicable law gives you a non-waivable right to reject an arbitration agreement, that right is preserved. Counsel should confirm whether an opt-out procedure or additional consumer notices are required before this section is published.
20. Waiver and Severability
A failure to enforce any provision of these Terms is not a waiver of that provision or any other provision. If a court or arbitrator finds a provision invalid, illegal, or unenforceable, the provision will be enforced to the maximum extent permitted or severed, and the remainder of the Terms will remain in effect. If the class-action waiver in Section 19 is found unenforceable as to a particular claim, that claim will proceed in a court of competent jurisdiction rather than class arbitration, unless applicable law requires otherwise.
21. Geographic Restrictions and Service Availability
The Website is intended for users in the United States. You are responsible for compliance with laws applicable where you access it. Clinical services are available only when a Clinical Provider is appropriately licensed and the requested service is lawful and operationally available in the patient's location. Jenla may request location, identity, age, and eligibility information and may restrict or deny access where requirements are not met.
22. Entire Agreement and Assignment
These Terms, Jenla's Privacy Policy and Cancellation and Refund Policy, and any additional terms accepted during intake, checkout, enrollment, or telehealth consent constitute the agreement governing the applicable subject matter. They supersede prior or contemporaneous communications concerning that subject matter. You may not assign your rights or obligations under these Terms without Jenla's written consent. Jenla may assign these Terms as part of a merger, reorganization, financing, sale of assets, or transfer of the applicable business, subject to applicable law.
